The following is an amended version of the agreement users digitally sign when creating a profile with bimini ai. Use of the website also constitutes express agreement to the terms below.

Always consult the relevant manufacturer information and specification publications when applicable. bimini ai and its creators are not responsible for incorrect/inaccurate data or wrongful claims. Use this app, the website, and its features (calculators, tools, or reference materials provided) at your own discretion.
f does not exert individual editorial control over all or any materials that are posted on the iOS application or website by members or third parties and specifically disclaims any and all liability for any claims or damages that result from inaccurate information either in the published reference materials or posted by members or third parties.
bimini ai reserves the right to remove any materials that are posted on this site by its members or third parties that the organization finds objectionable.
Medical information or opinions published here by the bimini ai creators, its members, or any third party is not intended to nor cannot replace consultation with a qualified health care provider or medical professional. Please always consult an appropriate health care provider or manufacturer information before making any medical decisions. The bimini ai entity, its creators, Drs. Virdi and Hirabayashi, and official bimini ai affiliates (including but not limited to EyeFlyMD and AILabs.AI) do not and will not answer specific medical questions or make official referrals to specific health care providers.
LEGAL AND WARRANTY NOTICE
The calculators and data input tools are provided “as-is” with NO warranty in any capacity. The diagnostic information provided by the bimini ai tools are provided for user convencience and should not be used for final medical decision making or as a substitute for medical expertise.
Efforts are continuously made by the bimini ai creators and affiliates to make the information provided by the calculators and tools helpful and accurate. Drs. Virdi and Hirabayashi do not official endorse or warrant the accuracy of the information obtained from the calculators, tools, or reference material on the iOS application or website. Members or users assume all risks and responsibilities for conclusion made from the use of the calculators and tools provided by bimini ai to achieve the users desired results. Due to this, users of the iOS app, the website, and tools hosted therein agrees that Drs. Virdi and Hirabayashi shall have no liability, contingent or otherwise, for the accuracy or timeliness of the services or products, of the accuracy, timeliness, or completeness of the calculator, tools, or reference materials, or for any decision made or action taken by users in reliance upon the calculators, tools, or reference materials, or for any interruption or delay of any data, material, or any other aspect of the calculators, tools, or reference materials.
To the maximum extent permitted by applicable law, Drs. Virdi and Hirabayashi and official affiliates of the bimini ai platform disclaim and exclude all representations, warranties, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and noninfringement with respect to the calculators, tools, or reference materials provided.
Users hereby acknowledges that the calculators, tools, or reference materials hosted by the bimini ai platform (iOS and web-based) may not be available or may become unavailable due to any number of factors including, without limitation, periodic system maintenance, scheduled or unscheduled, acts of god, technical failure of the calculators, tools, or reference materials, telecommunications infrastructure, or delay or disruption attributable to viruses, denial of service attacks, increased or fluctuating demand, actions and omissions of third parties, or any other cause reasonably beyond the control of the platform creators. Therefore, Drs. Virdi and Hirabayashi expressly disclaim any express or implied warranty regarding system and/or calculator availability, accessibility, or performance.
LIMITED LIABILITY NOTICE
Users of the bimini ai platform and the calculators, tools, and reference materials it hosts assume the entire cost of any damage resulting from users application of the calculators, tools, and reference material and the information contained in or compiled by the calculators, tools, and reference material contained on the bimini ai platforms. To the maximum extent permitted by applicable law, in no event will Drs. Virdi or Hirabayashi or other official bimini ai affiliates be liable for any damages whatsoever (including, without limitation, direct, indirect, special, consequential, punitive or incidental damages, including but not limited to lost profits or damages that result from inconvenience, delay or loss of the use of the calculator) arising out of or related to the use or inability to use the bimini ai calculators, tools, or reference materials, even if either or both Drs. Virdi and/or Hirabayashi and/ or the bimini ai platform communication network in any capacity have been advised of the possibility of such damages.
DATA COLLECTION
Through use of the bimini ai platform iOS application or website and the calculators, tools, or reference material contained therein, users may be inputting patient data subject to the health insurance portability and accountability act of 1996 (“HIPAA”) despite that the bimini ai platform encourages HIPAA compliance from its users when working within the iOS application or website. This data will not be received, retained or used by the bimini ai platform or its creators.
Any information input into the calculator other than protected health information (“anonymous information”), may be used by Drs. Virdi and Hirabayashi to optimize or improve the calculator and other products and services offered by the bimini ai platform; detect, investigate and prevent activities that may violate our policies or be illegal; comply with our legal and regulatory obligations; for use in scientific research by Drs. Virdi and/or Hirabayashi or any affiliated persons or entities and for any other lawful purposes, including sharing or selling such information with third parties. When permitted or required by law, the bimini ai team may share any information with additional third parties for purposes including response to legal process such as in response to a subpoena.
CORRECTIONS
The creators, Drs. Virdi and Hirabayashi, and official affiliates make no guarantees of the accuracy of information provided by any aspect of the bimini ai network or comments, opinions, or other materials submitted by users. If there are inaccuracies with officially published bimini ai calculators, tools, or reference materials, every effort will be made to update and correct the errors in as timely a manner as possible.
Please submit all corrections to reference material to Drs. Virdi and Hirabayashi (support@biminiai.com) as we continuously look to improve.
AGREEMENT
This is the agreement required for bimini ai membership and to access the calculators and tools provided under the paid subscription. Use of this website even without membership constitutes agreement to the terms above.
Once a user has read this Agreement, and agreed to its terms and indicated such acceptance by clicking “I AGREE” when prompted on completion of their profile, users will be bound by the terms of the Agreement outlined above in its entirety. The bimini ai creators or affiliates may terminate this Agreement at any time if a user violates its terms. This Agreement constitutes the sole and entire agreement between the Parties hereto with respect to the subject matter hereof and supersedes any and all prior or contemporaneous agreements, representations, understandings, and arrangements, whether written or oral, between the Parties concerning the subject matter hereof.
